CHILDREN’S ONLINE PRIVACY NOTICE

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this notice, “parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child's parent to authorize the collection, use, and disclosure of the child’s personal information.

The terms "child" and "children" apply to individuals of the following ages by country and region:

  • South Korea: Under 14 years of age
  • USA: Under 13 years of age
  • Other regions: Under 16 years of age

This notice is intended to notify parents of:

  • The types of information we may collect from children.
  • How we use the information we collect.
  • Our practices for disclosing that information.
  • Our practices for notifying and obtaining parents' consent when we collect personal information from children, including how a parent may revoke consent.
  • All operators that collect or maintain information from children through our Sites, Apps, and services.

This notice only applies to only to children, and supplements our general privacy policy available here: Privacy Policy , which applies to all other individuals visiting our Sites and Apps, and using our services. Terms that are defined in the general privacy policy have the same meanings where used in this Children’s Online Privacy Notice.

Information We Collect from Children

Children can access our Sites, Apps, and services and their content without providing us with personal information. Some content and features, however, are available only to registered users and this will require us to collect certain information, including personal information, from them. In addition, we use certain technologies, such as cookies, to automatically collect information from our users (including children) when they visit or use the Sites, Apps, and services.

We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.

  • Information We Collect Directly. A child must provide us with the following information to register with this website: the child's name, email address, gender, date of birth, audition region, application category, address, social media ID, messenger ID, application channel, phone number, height, weight, and photographs/videos/other creative content uploaded by the applicant, as well as a parent’s phone number, their email address, name (first and last), address, postal code, Social Security number, and date of birth for the purposes of obtaining verifiable parental consent. We may request additional information from your child, but this information is optional. We specify whether information is required or optional when we request it.
  • Cookies and Similar Technology. We use technology to automatically collect information from our users, including children, when they access and navigate through our Sites and Apps and use certain of their features. We use Cookies to record information about your use of our services (visit timestamps, IP address and other service usage records), your device (UDI and OS version), your browser and, in some cases, your preferences and browsing habits. How We Use Your Child’s Information

We use the personal information we collect from your child to:

  • register him or her with our Sites, Apps, and services;
  • operate our business and provide our Sites, Apps, and services;
  • communicate upcoming changes of our Sites, Apps, and services;
  • record any user preferences, including revocation of consent/opt-out;
  • manage, operate and audit our communications, IT and security systems;
  • conduct surveys and events;
  • conduct user verification and other necessary measures to ensure security;
  • detect and prevent breaches of policy and law;
  • analyze statistics on service use;
  • improve our Sites, Apps, and services;
  • develop new Sites, Apps, and services;
  • comply with law; and
  • establish, exercise, and defend legal claims.

We use the information we collect automatically through technology and other non-personal information we collect to improve our Sites, Apps, and services; and to deliver a better and more personalized experience.

Our Practices for Disclosing Children’s Information

We do not share, sell, rent, or transfer children's personal information other than as described in this section.

We disclose children’s personal information to other entities within the HYBE group, for legitimate business purposes and the operation and provision of our Sites, Apps or services to you, in accordance with applicable law. In addition, we disclose children’s personal information to:

  • you and, where appropriate, your appointed representatives;
  • legal and regulatory authorities, upon request, or for the purposes of reporting any actual or suspected breach of applicable law or regulation;
  • accountants, auditors, consultants, lawyers and other outside professional advisors to HYBE, subject to binding contractual obligations of confidentiality;
  • third party Processors, located anywhere in the world, subject to the requirements noted in Section 4, 5, 6 of our Privacy Policy
  • any relevant party, regulatory body, governmental authority, law enforcement agency or court, to the extent necessary for the establishment, exercise or defence of legal claims;
  • any relevant party, regulatory body, governmental authority, law enforcement agency or court, for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties;
  • any relevant third party acquirer(s) or successor(s) in title, in the event that we sell or transfer all or any relevant portion of our business or assets (including in the event of a reorganization, dissolution or liquidation); and
  • any relevant third party provider, where our Sites and our Apps use third party advertising, plugins or content. Where a child chooses to interact with any such advertising, plugins or content, their personal information may be shared with the relevant third party provider. We recommend that you review that third party’s privacy policy before interacting with its advertising, plugins or content.

Accessing and Correcting Your Child’s Personal Information

At any time, you may review the child’s personal information that we maintain and require us to correct or delete the personal information, and/or revoke your consent for the further collection or use of your child’s information.

You can review, change, or delete your child's personal information by:

  • Sending us an email at [audition_cs@hybeaudition.com]. We note, to protect your privacy and security, and the privacy and security of your child, we may require you to provide additional information to verify your identity before we provide any information or make corrections.
